Proposed Changes to Hardship Waiver

USCIS has proposed changes to reduce the time that U.S. citizens are separated from their spouses and children while they go through the process of becoming legal immigrants to the United States.
The proposed changes would do away with the current rule that requires the alien spouse of a U.S. citizen to depart the U.S. and apply for a visa and a waiver from a foreign consulate.  That process would sometimes result in months or years of separation for the family.
